The Secret Set – Terms and Conditions Introduction The Secret Set subscription is operated by Secret Spa (London) Limited, company number 09470015, with its registered office at The Handbag Factory, 3 Loughborough Street, London, SE11 5RB Customers must be 18 or over and live in London, Manchester or Brighton to use The Secret Set You can sign up to The Secret Set at www.secretspa.co.uk (the “Website”) or via the Secret Spa app (the “App”) under your account Signing up to The Secret Set By signing up to The Secret Set, you agree to be deemed to have accepted these terms and conditions, so we recommend that you read them carefully. Your subscription will commence, and a contract is formed on receipt of successful payment by us from you. Your subscription term will last for an initial month from the date of successful payment and will continue thereafter on a rolling monthly basis unless cancelled or paused in accordance with the instructions provided in Cancellation – The Secret Set subscription.’ By signing up to The Secret Set, you will receive: (i) 10% complimentary Account Credit each month (ii) Account Credit amounting to your monthly contribution that is fully redeemable against all beauty & wellness treatments. Account Credit Account Credit will be automatically issued to your account on the date of successful payment and confirmed by email. Account Credit can be redeemed against all beauty & wellness treatments. The Account Credit can only be redeemed for bookings that take place in our serving areas: (i) London (ii) Manchester (iii) Brighton. For full details on the areas we service, please visit the website www.secretspa.co.uk To redeem your Account Credit simply complete the booking checkout as normal. Any credit on your account will automatically be deducted from the total value of your booking and detailed on your payment receipt. If the total value of your booking is not covered by your Account Credit, payment for the outstanding balance will be taken as normal by card. Account Credit can be redeemed in multiple transactions. The value of your Account Credit will reduce as you spend it. Account Credit cannot be redeemed against gift cards or in addition to other discount codes or offers. Account credit can be transferred to another person for a charge of £5 until the moment of booking with a Therapist. After this time, you will be required to speak to the Therapist directly to see if they can treat another person. Any unused Account Credit will expire on the date falling 6 months from the subscription payment date. Secret Spa is the issuer of the Account Credit and reserves the right to make changes to complimentary account credit, terms and services on which it can be redeemed The subscription payment An initial payment will be taken on the date in which you create The Secret Set account. Following this, a monthly payment will be taken on or before that same date each month (the “Subscription Payment Date”). When you give your credit or debit card details you are confirming that you are either the cardholder, or that you have permission from the cardholder to use the card for the purpose of signing up to The Secret Set. You agree and acknowledge that your subscription has an initial and recurring payment charge at the then-current subscription rate and you accept responsibility for all recurring charges prior to cancellation, including where applicable any charges processed by us after the expiration date of your payment card. No payment will be taken from your card until your monthly payment is due. Your subscription payment will be handled by a third party. Please note, when you place an order for The Secret Set, the third party will securely store your card details in order for it to take your monthly payment You are due to pay all subscription amounts to us by the Subscription Payment Date. If payment is not made your Account Credit for that month will not be issued. Any sums not paid following the date falling two calendar months from the Subscription Payment Date will result in your The Secret Set account being paused. You may restart your The Secret Set subscription at any time by selecting ‘Manage my subscription’ under your account. Refunds If we have been unable to fulfil part or all of your booking that was purchased in whole or in part with Account Credit, your refund will be returned to your original payment method. All refunds will be subject to the Secret Spa Cancellation Policy here. Where you make a purchase using your Account Credit, you will not be entitled to a cash refund in any circumstances. Cancellation – The Secret Set subscription You may cancel or pause your The Secret Set subscription at any time by selecting ‘Manage my subscription’ under your account. To cancel your The Secret Set subscription, please do so via your account at least 72 hours before your next billing date. The cancellation will come into effect at the end of that current billing month. This paragraph does not affect your statutory rights as a consumer, including, where applicable, your right to cancel your subscription in accordance with your statutory rights. To exercise your statutory rights, please contact Customer Services via bookings@secretspa.co.uk. We reserve the right to cancel or amend your The Secret Set subscription or its terms (including the price of the subscription) at any time. We will provide you with notice of any changes to these terms. You may cancel your subscription in accordance with this paragraph if you do not wish to proceed with any changes. If you continue to use your The Secret Set account, you will be deemed to have accepted any changes. Data We are the data controller of any personal information that we collect from you in order to administer The Secret Set. We take the protection of your personal information seriously. You can find out more about how we process your information by viewing our Privacy Policy here. Where you have consented for us to do so, we will send you the latest news from Secret Spa, including exclusive membership offers. You can manage your preferences, or unsubscribe by following the link in the email. You may receive emails or other communications from us from time to time which strictly relate to the service we are providing to you through The Secret Set. If you no longer wish to be part of The Secret Set, you can cancel your subscription in accordance with unless cancelled or paused in accordance with the instructions provided in Cancellation – The Secret Set subscription. Should your contact details change during the term of your subscription, these can be updated via your account with any such amendments taking effect shortly thereafter*.* You will be responsible for providing valid contact and address details and for ensuring these details are up to date. General We reserve the right to cancel your The Secret Set subscription account at any time if we have reasonable grounds for believing that you are not complying with these terms If we fail to comply with these terms, we may be responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process. We will not be held responsible for any delay or failure to perform or comply with our obligations under these terms if the delay or failure arises from any cause which is beyond our reasonable control. Notwithstanding the foregoing, our entire liability to you for any loss or damage suffered by you shall be limited to 100% of the total amount of The Secret Set subscription fees paid by you to us during the 12 months preceding the date of the matter or event giving rise to your loss or damage. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to the products you purchase from us. The Secret Set subscription does not override our general terms and conditions. Secret Spa facilitate introductions between Clients and Therapists. The issuance of Account Credit by Secret Spa enables the Client to redeem this credit against services provided by the Therapist to the Client. You can view our general terms and conditions here.
